Welcome to ShiftTracker. These Terms of Service ("Terms") govern your access to and use of the ShiftTracker website at shifttrackerapp.com and the ShiftTracker application (collectively, the "Service"), operated by ShiftTracker ("we," "us," or "our").
Please read these Terms carefully before using the Service. By creating an account or using any part of the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not access or use the Service.
2. Service Description
ShiftTracker is an earnings and mileage analytics platform designed for gig economy workers. The Service allows users to:
- Log and track shift hours, earnings, tips, and expenses across multiple gig platforms
- Record mileage for IRS-compliant tax deduction purposes
- View real-time earnings analytics, heatmaps, and AI-powered insights
- Export shift and mileage data for tax preparation
- Set income goals and receive personalized recommendations
The Service is provided as a tool for personal record-keeping and analytics. ShiftTracker does not provide tax, legal, or financial advice. Users should consult qualified professionals for tax and financial decisions.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activity that occurs under your account
- Notify us immediately if you suspect unauthorized access to your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Submit false, misleading, or fraudulent data
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Interfere with or disrupt the Service or its infrastructure
- Use the Service for any purpose that is illegal or harmful
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or use automated means to access the Service without our written permission
- Resell, redistribute, or sublicense access to the Service
5. Intellectual Property
The Service, including its design, code, text, graphics, logos, and all other content, is owned by ShiftTracker or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, copy, distribute, or create derivative works based on the Service.
You retain ownership of the data you input into the Service (shift records, mileage logs, expense data). By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing and improving the Service.
6. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to the practices described in the Privacy Policy.
7. Subscription Plans & Payments
ShiftTracker offers both free and paid subscription plans. Details of each plan, including pricing and features, are available on our Pricing page.
- Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select.
- Mobile subscriptions purchased in our app are billed through the Apple App Store or Google Play, with RevenueCat managing your subscription status. Web-based purchases are billed through Stripe. We do not store your payment card details.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Unless you cancel in time, your subscription renews and your payment method is charged for the next period at the then-current price.
- To cancel, manage app-store subscriptions in your Apple App Store or Google Play account settings; manage web subscriptions through our billing portal.
- Prices are subject to change with 30 days' advance notice to active subscribers.
Automatic renewal disclosure. Paid subscriptions and free trials are automatic-renewal offers. When you subscribe, your subscription automatically renews at the end of each billing period (monthly or annual, as selected), and your payment method is charged the then-current price shown at the time of purchase and on our Pricing page, until you cancel. If you start a free trial, it converts into a paid subscription at the end of the trial period unless you cancel before the trial ends. You may cancel at any time before the next renewal date — for mobile subscriptions, through your Apple App Store or Google Play account settings; for web subscriptions, through our billing portal. Canceling stops future renewals; it does not retroactively refund the current period (see Section 12).
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee the accuracy, completeness, or reliability of any data, analytics, or recommendations provided through the Service.
ShiftTracker is a tracking and analytics tool, not a tax preparation service. Mileage logs and earnings data generated by the Service are for informational purposes and should be verified by a qualified tax professional before being used for tax filings.
Certain features of the Service — including vehicle cost-per-mile estimates, profit insights, and the in-app assistant — use artificial intelligence. AI-generated outputs are estimates provided for informational purposes only. They may be inaccurate or outdated and do not constitute financial, tax, or professional advice. You should verify AI-generated information independently before relying on it.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIFTTRACKER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
10. Termination
You may terminate your account at any time by contacting us at team@shifttrackerapp.com or using the account deletion feature in the app settings.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or extended inactivity.
Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
11. Data Deletion
You have the right to request deletion of your personal data at any time. Upon receiving a valid deletion request:
- We permanently remove your account and personal data from all of our application databases immediately — well within 30 days
- Anonymized, aggregated data that cannot identify you may be retained
- Anonymized diagnostic and crash logs, which do not identify you, may be retained after deletion for service-reliability purposes
- Data required by law to be retained will be kept for the minimum required period
- Backup copies may persist for up to 90 days before being permanently removed

12. Refund Policy
How refunds are handled depends on where you made your purchase:
- Apple App Store or Google Play purchases: These are governed by Apple's and Google's refund policies, and refund requests must be made through those stores. For Apple, visit reportaproblem.apple.com; for Google Play, visit Google Play's refund page. We are not able to issue refunds for purchases billed by Apple or Google.
- Web purchases billed directly by us through Stripe: If you are not satisfied, you may request a refund within 7 days of your initial purchase or renewal by emailing team@shifttrackerapp.com. Refunds are issued to the original payment method within 5–10 business days. Requests after the 7-day window are evaluated on a case-by-case basis, and partial-month refunds are not provided for annual subscriptions canceled mid-term.
- Free trial: ShiftTracker offers a 7-day free trial with no payment method required. No payment is collected during the trial, so the trial period is not subject to refunds.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except where prohibited by law.
Your right to opt out of arbitration. You may opt out of the arbitration agreement and the class-action waiver in this Section by notifying us in writing within 30 days of the date you first accept these Terms (or within 30 days of the date this arbitration provision first becomes applicable to you). To opt out, email team@shifttrackerapp.com with your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms, and it will not affect any separate arbitration agreement between us.
Notwithstanding the above, either party may bring an individual claim in a small-claims court of competent jurisdiction if the claim qualifies for that court.
You agree to resolve disputes on an individual basis and waive the right to participate in a class action lawsuit or class-wide arbitration, to the extent permitted by law.
If you opt out of arbitration, or for any dispute that is not subject to arbitration, you and ShiftTracker agree to the exclusive jurisdiction of the state and federal courts located in the State of Idaho.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by posting the revised Terms on this page and updating the "Last Updated" date. For significant changes, we may also notify you via email or in-app notification.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and delete your account.
